Welcome to the HubSpot Merch Store at shop.hubspot.com (the "Website"). These Terms and Conditions of Use ("Terms") govern your access to and use of the Website and the services and content available through it (collectively, the "Services").
The Store is operated by &Open Inc, a company incorporated in Ireland ("&Open", "we", "us", "our"), on behalf of HubSpot, Inc. ("HubSpot"). "You" and "your" refer to each customer, user, or visitor.
Please read these Terms carefully. By using the Website or placing an order, you agree to be bound by them. If you don't agree, please don't use the Services. We may update these Terms at any time by posting a revised version on the Website. Continued use after an update constitutes acceptance.
Please be aware that we may update and change any part or all of these Terms and Conditions at any time without notifying you first. If we update or change these Terms and Conditions, the updated terms will become effective and binding on the next business day after they are posted. When we change these terms, the “Last modified” date listed on this page will be updated to reflect the date of the most recent version. If you don’t agree to these terms, then you should not purchase UNBOUND merchandise.
Products and Pricing
Once you complete the purchase of your merchandise, the purchase and rate are final and won’t be adjusted later. It is your responsibility to confirm that the price displayed at checkout is the price that you expect and agree to pay before you complete your purchase. Credit cards will be charged at the time your order is placed.
We make reasonable efforts to display products and prices accurately but do not warrant that content is complete, current, or error-free. We may correct errors at any time without notice, including after an order is submitted, and reserve the right to cancel orders placed at incorrect prices. Products are subject to availability and may be discontinued at any time.
Orders
Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion. An order is confirmed only upon written confirmation from us.
Pickup
All orders must be picked up onsite at Boston's Thomas M. Memino Convention & Exhibition Center, during UNBOUND, September 16-18, 2026. Anything not picked up will be donated. We will not ship items to individuals or process refunds for items not collected.
To pickup your order at the venue, you’ll need your confirmation email and valid photo ID.
Data and Privacy
By placing an order, you agree that your order information and personal data (name, address, contact details) will be shared with HubSpot as part of the gifting programme, and processed by &Open and its sub-processors for fulfilment and customer support. Data is handled in accordance with &Open's Privacy Policy.
&Open may share information with HubSpot relating to you, your orders, and your correspondence. HubSpot will handle this information in line with their Privacy Policy.
Acceptable Use
You must not:
- Use bots, scrapers, crawlers, or automated tools to access the Website;
- Use the Website or its content for any commercial purpose not permitted by these Terms;
- Copy, reproduce, or distribute Website content without our prior written consent;
- Send unsolicited communications in connection with the Website;
- Interfere with or attempt to gain unauthorised access to the Website or its systems;
- Collect personal information from other users without their consent;
- Infringe the rights of &Open, HubSpot, or any third party.
Intellectual Property
All content on the Website — logos, graphics, images, and text — belongs to &Open, HubSpot, or their licensors. Nothing in these Terms grants you any licence to use such content beyond what is expressly permitted.
Feedback
By submitting feedback, comments, or suggestions ("Feedback"), you grant &Open a non-exclusive, worldwide, perpetual, royalty-free licence to use and exploit that Feedback for any purpose.
Third-Party Services
The Website may operate on or alongside third-party platforms, including Shopify. &Open is not liable for claims or damages arising from third-party services. Your use of any such platform is governed by its own terms.
Indemnification
You agree to indemnify and hold harmless &Open, HubSpot, and their respective officers, directors, agents, and employees from any claims, damages, or costs (including legal fees) arising from your use of the Services or breach of these Terms.
Disclaimers and Liability
The Services are provided "as is." To the extent permitted by law, &Open disclaims all express and implied warranties. Our total liability for any order shall not exceed the amount you paid for it. We are not liable for indirect, incidental, or consequential losses. Nothing here limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
Disputes
If you have a dispute, please contact us first at support@andopen.co and we'll try to resolve it. If we can't, these Terms will govern any resulting legal proceedings.
Governing Law
These Terms are governed by the laws of the State of California. Any disputes are subject to the exclusive jurisdiction of California courts.
Geographic Scope
The Website is intended for use within the United States only. We make no representation that the Services are appropriate or available outside the US.
